二、經(jīng)營(yíng)許可證是營(yíng)業(yè)執(zhí)照嗎

二者不能等同。

根據(jù)法律規(guī)定，營(yíng)業(yè)執(zhí)照是法律主體進(jìn)行市場(chǎng)交易主體資格的法定證明，目前有法人類(lèi)營(yíng)業(yè)執(zhí)照、個(gè)人獨(dú)資企業(yè)營(yíng)業(yè)執(zhí)照、合伙企業(yè)營(yíng)業(yè)執(zhí)照和個(gè)體工商戶(hù)營(yíng)業(yè)執(zhí)照等；營(yíng)業(yè)執(zhí)照由工商局頒發(fā)，每年年檢。而經(jīng)營(yíng)許可證，是法律規(guī)定的某些行業(yè)必須經(jīng)過(guò)許可，而由主管部門(mén)辦法的許可經(jīng)營(yíng)的證明，如煙草專(zhuān)賣(mài)許可等。營(yíng)業(yè)執(zhí)照是每個(gè)開(kāi)門(mén)做生意的經(jīng)營(yíng)者都需要辦理的證件，沒(méi)有這個(gè)證件，就是無(wú)照經(jīng)營(yíng)行為，是違法的。經(jīng)營(yíng)許可證是做某種方面的生意所必須取得的證件，這個(gè)證件必須在辦理營(yíng)業(yè)執(zhí)照之前取得，也就是所謂的前置許可審批文件，例如賣(mài)煙的話，需要在辦營(yíng)業(yè)執(zhí)照之前取得《煙草零售經(jīng)營(yíng)許可證》，賣(mài)食品需要在辦營(yíng)業(yè)執(zhí)照之前取得《食品流通許可證》，開(kāi)飯店，搞餐飲服務(wù)的，需要在辦營(yíng)業(yè)執(zhí)照之前取得《餐飲經(jīng)營(yíng)許可證》，不一而就。
